Terms of Service ("Terms")

Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the http://www.fclslegal.com website (the "Service") operated by Family Choice Legal Services LLC ("us", "we", or "our").

 

Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who wish to access or use the Service.

 

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you do not have permission to access the Service.

Introduction

 

Welcome to Family Choice Legal Services (FCLS). We understand that most family law cases that go through the courts are not easy. An individual seeking to go through the process alone with no legal background can often feel helpless and overwhelmed. We also know that many people going through such circumstances cannot afford the high cost of an attorney. It is our goal to provide an affordable, comprehensive solution that gets you through the process from start to finish as painlessly as possible. 

 

Family Choice Legal Services (FCLS) is not a law firm.  Rather, we are a family advocacy group that helps families and individuals through their issues of custody, divorce, visitation, child support, guardianship, etc. as “pro se” or “pro per” litigants. This means that you will not have an attorney standing next to you when you go to court. You will, however, have the help of our qualifying advocates, case managers, private investigators, and legal staff consisting of attorneys, paralegals, legal documents assistants (LDA’s), and/or document specialists when preparing the documents that will be seen by a mediator and/or judge.

Please make sure to write down any questions or concerns you may have. Your thorough understanding of our services is very important to us.

Cost of Services

Most cases with Family Choice Legal Services (FCLS) will be quoted between $900-$1200. This includes more common cases such as parental custody, visitation, support, etc. Cases such as guardianship and conservatorship will typically be quoted between $1200-$1500. In rare cases such as uncontested divorces and child support matters that do NOT include children and/or assets, the case may be approved for less. Once you have submitted your original Questionnaire, your Case Manager will provide you with a Case Summary with the quote for your specific case.

In order to enroll in the program, you will be required to pay $100. This is a non-refundable fee that essentially makes you a member in our Family Advocate Program. The $100 enrollment counts towards the total cost of your case. 

 

After you have been enrolled in the program, you will be assigned to a Case Manager. The Case Manager is not an attorney. Your Case Manager is there to provide one on one assistance for the rest of the case. While he or she works with you, they will also work on your case with the legal staff. It is the Case Manager’s responsibility to assist you in collecting relevant information such as the questionnaire, signed User Terms of Service Agreement, payment information, previous court orders, and supporting documents for the case.

 

An additional monthly membership fee of $49 will begin seven days after your initial enrollment.  After the first payment, the $49 will become a monthly charge automatically charged from the original payment method provided. This monthly membership does NOT count towards the total cost of your case. While Family Choice Legal Services (FCLS) does not charge hourly for our services, the monthly membership is in place to cover administrative costs.

 

If you wish to put your case on hold or cancel for any reason, we insist that you make your request in writing. Requests in writing can be submitted by email to your Case Manager or support@fclslegal.com. We will not accept any requests by phone as there is no way to authenticate such a request after the fact. The monthly membership fee may be suspended or reactivated at any time. If you wish to change the billing date, please notify your Case Manager in writing as soon as possible. You may also email support@fclslegal.com.

 

Additional documents: In rare cases, the legal staff may determine that your case requires additional documents. In such instances, you will be notified by your Case Manager as well as receive a revised Case Summary. A typical quote for additional documents will be between $100-$300.

 

Private Investigator: If a private investigator’s services are required to locate an address of the other party, there is an additional $150 fee. Clients are encouraged to provide the address of the other party in order to avoid paying this additional charge. While we are generally successful in locating the other party, FCLS makes no guarantee that address location is perfect.

 

Payments: Family Choice Legal Services (FCLS) understands that most people cannot pay an attorney $2,000-$5,000 upfront for their case. We provide flexible payment plan options for every client. Please consider this a pay as you go relationship. In order to receive your rough draft, however, all payments must be made in full. We will not provide partial documents for partial payment. All payments made, regardless of whether or not documents have been finalized, are non-refundable. 

 

All prepared documents will be delivered via email.

Intellectual Property 

The Service and its original content, features and functionality are and will remain the exclusive property of Family Choice Legal Services LLC and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Family Choice Legal Services LLC.

Links To Other Web Sites

Our Service may contain links to third party web sites or services that are not owned or controlled by Family Choice Legal Services LLC.

Family Choice Legal Services LLC has no control over, and assumes no responsibility for the content, privacy policies, or practices of any third party websites or services. We do not warrant the offerings of any of these entities/individuals or their websites.

 

You acknowledge and agree that Family Choice Legal Services LLC shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such third party web sites or services.

 

We strongly advise you to read the terms and conditions and privacy policies of any third party web sites or services that you visit.

Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Indemnification

You agree to defend, indemnify and hold harmless Family Choice Legal Services LLC and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.

Limitation Of Liability

In no event shall Family Choice Legal Services LLC, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

Family Choice Legal Services LLC, its subsidiaries, affiliates, and its licensors do not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.

Regardless of how you feel about your case, it does not guarantee the judge will feel the same way. It is our goal to take the information you provide us and provide properly prepared documentation to give you the best chance possible in your case. Family Choice Legal Services (FCLS) makes no guarantee of the outcome of your case. This program is not meant to construe legal advice or be used in lieu of an attorney. Any contact you have with Family Choice Legal Services (FCLS) or any of its independent contractors is not intended, nor will it be considered, an attorney-client privilege. 

Family Choice Legal Services (FCLS) typically provides filing and service instructions to clients. We are not responsible, nor will we, file or serve any documents on your behalf. If you have difficulty filing or if the courts reject your documents, please let us know as soon as possible. This can happen often to even the best of attorneys. If it happens to you, please contact us immediately.

Exclusions

Some jurisdictions do not allow the exclusion of certain warranties or the exclusion or limitation of liability for consequential or incidental damages, so the limitations above may not apply to you.

Governing Law and Arbitration

These Terms shall be governed and construed in accordance with the laws of Idaho, United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have had between us regarding the Service.

Family Choice Legal Services (FCLS) is headquartered out of the city of Meridian, Idaho. Members of the previously mentioned legal staff (attorneys, paralegals, legal documents assistants or LDA’s, and document specialists) are independent contractors. By signing the User Terms of Service Agreement, I agree that should any dispute arise, Idaho law will govern said dispute between myself, the User of services of Family Choice Legal Services (FCLS) and Family Choice Legal Services (FCLS).

 

If the User believes Family Choice Legal Services (FCLS) to be in violation of this User Terms of Service Agreement or the Privacy Policy on www.fclslegal.com, and both parties cannot reasonably settle differences amongst themselves, the place of arbitration will be Meridian, Idaho. Both parties also agree to cover their own attorney fees as well as arbitrator/arbitration and court costs.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.

Summary

We very much look forward to helping you through your individual situation. As previously stated, going through a family law situation can be very difficult to do alone. We ask that you do your best to compartmentalize your case. The best way to do so is to stay in contact with your Case Manager, and to let us know when something new arises. Most often your Case Manager will ask you to complete our Questionnaire, sign the User Terms of Service Agreement, send in any previous court documents as well as any evidence you think may help your case, and sign your Payment Plan. Take your case one step at a time, and remember why you are doing this!
